On 1 April 2007, as a result of the Police, Public Order and Criminal Justice (Scotland) Act 2006, the Scottish Crime and Drug Enforcement Agency (SCDEA) became a statutory body, maintained by the Scottish Police Services Authority (SPSA).
The 2006 Act includes the SPSA as a 'public authority' under the amendment to Schedule 1 of the Freedom of Information (Scotland) Act 2002 (FOISA), but only in relation to those police support services it provides.
The SCDEA is not a police support service and is therefore not included in Schedule 1. In other words, the SCDEA is not covered by the provisions of FOISA.
Requests for information about particular activities of the SCDEA will be refused. However, the Agency may respond to reasonable requests for information, although not under the provisions of FOISA legislation, if such information is held.
At the same time, the Agency aims to make non-operational information available on this website, which will include documents such as the SCDEA Annual Report and Plan.
